The American Council's Position on Proposition 3
Sacramento, CA — Proposition 3, a central issue for California voters, will be voted on in this election. Listed as an official opponent is Rev. Tanner DiBella, the founder and President of the American Council.
Tanner DiBella released the following statement about Proposition 3:
Same-sex unions are legal at a federal level (Obergefell v. Hodges). This proposition does not afford any more rights to those in a same-sex union. None.
In public policy, language, or the lack thereof, matters. When you protect a fundamental right, definition is paramount. Without it, there’s ambiguity. Ambiguity in legislation creates loopholes that can be exploited, leading to inconsistent application of the law and allowing for unintended interpretations that may undermine its original intent.
California is one of a few states with no minimum age at which a person can enter into a marriage or a domestic partnership. Many in the public policy space have concerns that this proposition is too vague and would lead to the exploitation of children through underage marriages.
Attorney General Rob Bonta has told school districts that parental notification policies are illegal because students have an alleged right to privacy. In other words, a fundamental right supersedes the rights of guardians and parents.
